DRAFT LOCAL PLANNING POLICY (LPP32)

The public comment period ends on 4th Feb.

MHAG is supportive of a Community Benefits Policy that provides real & substantial community benefits in exchange for strictly limited developer bonuses, however the current draft policy does not do this.

MHAG engaged Hemsley Planning to undertake a Peer Review of the Draft Local Planning Policy (LPP32) and you can read a copy of their report below:

Hemsley recommended the "Town withdraw the draft Policy from community consultation or perform necessary posturing to avoid the still draft Policy being relied upon and given weight by a determining authority other than the Town."

We have serious concerns that in its present form, the Draft Policy:

Allows developers to exceed height and bulk limits anywhere in Mosman Park

Provides no tangible community benefits

Puts developers’ profits ahead of local amenity

Suggested comment for Section 4:


The Draft Local Planning Policy LPP32 is fundamentally flawed and should be withdrawn.  The draft:

Places no upper limit on height and bulk discretion that a developer can apply for which is contrary to State Planning Policy (SPP) 7.3

Applies to all of Mosman Park instead of being targeted to areas as recommended by SPP7.3

Allows a developer to claim as a community benefit features which they should provide in any event (like car parking, lighting, accessibility, diversity of dwellings, retention of vegetation, verge design)

Ignores the recent community needs analysis in favour of vague, generic and irrelevant 'elements'.  It will not improve our amenity.

I urge council to consider the Peer Review of Draft LPP32 prepared by Hemsley Planning on behalf of MHAG, withdraw the draft policy at the conclusion of the public comment period, and rethink their approach to this important issue.
